so ... as long as the 4th amendment gets upheld (because they're explicitly promising not to prosecute if the get permission to look without a warrant), this is business as usual and potential a good thing. assuming the 4th amendment gets upheld.

but ... they get permission once and confiscate illegal weapons/drugs and there's not prosecution and all is good. then they get another report that same kid has another illegal gun. now they've confiscated before under this program ... easier to get a warrant and prosecute now? still not necessarily a bad thing ... kid did get one get out of jail free warning on this and is stupid enough to do it again.

i'm seeing good here unless they try to prosecute for the first offense where they promised no prosecution (because of the 4th amendment violation - ya, they had permission, but it was granted on the basis that they wouldn't prosecute for guns or drugs if permitted the opportunity to search; prosecuting would break that verbal contract IMO and make the granting of permission null and void and the search illegal).

my paranoid libertarian side says there must be a down side to this even if the 4th amendment gets upheld and they really don't prosecute for guns/drugs if found with permission to search. but i'm having trouble finding it. where is it?

i'm not sure i like this statement: He also said that there are practical concerns from a law enforcement perspective: If you're responding to the scene of a shooting, how do you sort out who is the bad guy and who is the heroic student with a permit?

i mean i understand the difficulty in interpreting a scene when you arrive there and the potential consequences ... but basically a statement like this says citizens should not have the right to bear arms because it confuses the police.

is DSS responsible?

ok, i get that the kids were being neglected and DSS doesn't appear to have done enough on that front, but are the kids' deaths really on DSS? this appears to be an arson fire which means it wasn't mom being neglectful and passing out drunk with a lit cigarette. i don't neglect my son and some one could still light fire to my house without my knowledge or permission - should DSS preemptively take my son?

yes, if the DSS had taken the kids they wouldn't have been in that house at the time of the fire. but if the kids had a sleepover somewhere else they also wouldn't have been home.

until i see that the fire was some how caused by mom's neglect (or kids could have gotten out with mom's help if she had been more attentive), i don't see how this reflects on DSS at all.

digital life

yet another justification for my scrapbooking hobby ... that i really need to get back to. digital media does seem so permanent but even if the storage media didn't change, with software evolution would we still be able to access old files?

digital helps me with my scrapbooks - i can sort thru digital images, chose the ones that tell the story, create stickers and fonts to embellish, use google to find the perfect quote - but it seems to be a better temporary workspace than a permanent medium. the power goes out, we can still look at our family albums by candlelight.

i guess the flip side is the house burns down, i can still access the backups of my digital images on mozy and recreate those scrapbooks.
